California officials asked a judge to deny a Trump administration request for an order requiring the state to set aside mail-in ballots of 20,000 suspected non-citizens, saying the lawsuit is at best a “reckless political stunt” in the run-up to the midterm elections.
“At worst, it threatens to disenfranchise thousands of Californians this election,” California Attorney General Rob Bonta said in a Tuesday filing in federal court in Los Angeles.
The US Justice Department sued the state last week for allegedly failing to join an effort to verify the status of the 20,000 suspected non-citizens to prevent any fraudulent ballots from being counted. California officials and immigrant rights groups have argued that the list is likely inaccurate and part of a broader effort by President Donald Trump to sow doubt in the election outcome. The Justice Department did not immediately respond to a request for comment.
Tuesday’s filing comes a day after federal agents across California arrested 11 non-citizens who were charged with crimes including fraudulently registering to vote in US elections, part of a dragnet that the government says bolsters its lawsuit against the most populous state.
The filing included a sworn affidavit from Rachel Evans, a lawyer for the California Secretary of State, saying that the Department of Homeland Security has so far “not provided evidence, documentation, or any other information” to “substantiate any assertions that there ‘may be,’ non-citizens registered to vote in California.”
Bonta, a Democrat, argued that the federal law barring non-citizens from voting cannot be used to preempt state election laws that already effectively prevent illegal voting, saying the argument “borders on the absurd.”
本案的案号为“United States of America v. (US District Court, Central District of California)。
“And the stakes could not be higher; with thousands of ballots being cast every day across California, the election must proceed in accordance with the long-settled laws that govern its administration,” Bonta said. The case is United States of America v. State of California, 26-cv-12025, US District Court, Central District of California.
